Customer agrees when using, or accessing our services that the following terms and conditions of this policy will be met:

Acceptable Usage Policy

• User agrees to use the service in manner consistent with any and all applicable laws, including the laws of the United States and State of California. In the event that this account is not used in accordance with all Applicable Laws including, but not limited to Local, State or Federal Laws, we reserve the right to cooperate with all or any law enforcement agencies.
• Spam: There is a zero tolerance policy for spam / unsolicited emails. Sending unsolicited email from your account, or email from elsewhere containing links to your account, will result in immediate termination with no refund.
• You are not allowed to install mailwizz or any other email marketing software. You can send emails from your personal email address, but cannot install or use software for bulk mailing purposes. Any software of this type will be deleted without warning and/or accounts will be immediately terminated with no refund.
• It is your responsibility to protect your login, passwords and ensure that the scripts, programs, and files you install are secure and updated. This includes WordPress files, themes and plugins.
• You will not host domains which violate trademarks or other intellectual property rights. The content you upload will violate copyright law, trademark law, or other intellectual property rights. Your content will not link to other websites which violate copyright law, trademark law, or other intellectual property rights.
• You agree to not use our hosting services for 'adult' related products or services, whether or not there is nudity. You also agree to not use your account to for warez, illegal file downloads, or for the distribution of .mp3 files.
• .tk, .gq and other free domains are not allowed.
• When creating an account you need to choose a domain. This is a domain you intend to keep. If you want to change the domain is requires time and manual changes on our end, and we charge a small fee of $10 to do this. Go here to pay this fee.
• You will not using our hosting services for spam websites. A spam website is commonly scraped content with meaningless words running together created to generate a backlink to another site.
• Users must maintain complete and accurate contact information with us, including email.
• Users agree to receive all messages from us, including any marketing messages via email, mail, telephone, cell phone, text, sms, fax, or any other method. Users with discounted offers, such as lifetime hosting, agree to receive such messages as a condition for the discount.
• Users cannot transfer their account to anyone else.
• You agree to defend us and to hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees, arising from content you have placed, or allowed to be placed (either intentionally, negligently, or inadvertently) in your account.
• Users are responsible for backing up their own data. Although our services may make daily backups, for legal reasons we do not guarantee they are made. We are not responsible for lost data.
• We are not responsible for Service Outages resulting from equipment owned by others, including, but not limited to, Internet NAP failures or congestion and backbone failures. Additionally, are not responsible for delays in the registration or transfer of a domain due to InterNIC-related issues, for outages resulting from malfunctioning customer scripts or applications that are installed by a customer, or for unusual traffic spikes or denial of service attacks on customer web sites.
• Neither we nor our Information Providers are responsible for any damages arising from User's use of ours or by User's inability to use our service. You are agree our limited to you is capped at the amount you have paid for our services.
• User hereby agrees that any material submitted for publication on our site through user's account(s) does not violate or infringe any copyright, trademark, patent, statutory, common law or proprietary rights of others, or contain anything obscene or libelous. User's may not host any hardcore adult content or porn websites. Software intended to facilitate any such violations or infringements may not be stored on our servers.
• There is a cap of 149,000 files per account. Going over the cap may result in your site being inaccessible and/or incurring a 500 Internal server error.
• User agree to not use excessive amounts of resources. Any violations may result in us taking corrective action in order maintain server stability by killing any processes, disabling and/or suspending your account. User may not use 50% or more of available system resources (CPU or memory) for longer then 30 seconds or more than 2% CPU daily, 3% memory daily. User may nut run more than 10 simultaneous processes per user or allow any process to run for longer than 30 CPU seconds or run any process that consumes more than 32 MB of memory. Databases are limited to 16 max user connections. Cron jobs must not execute more than once every 15 minutes. Each account may not send more than 200 emails per hour. If it is determined that a customers account is overusing the system resources, we may temporary suspend the account to prevent the server from experiencing any issues, resulting problems to other valued customers. If it is determined that the account is not suitable for a shared server environment the account may be terminated. We will be the sole arbiter as to what constitutes a violation of this provision and we reserve the right to make adjustments to these limits at our sole discretion.
• We reserve the right to monitor network usage and to throttle or limit the available speed to conserve network resources.
• You must not use our hosting to offer any of the following kinds of FREE services: Free Web hosting services, Free e-mail services, Free blogging services, Free home pages, Free image hosting, Free trial accounts.
• Abuse of our Staff or Support Personnel: We take pride in providing excellent service to all of our customers. It is our policy always to treat our customers with the highest level of respect and courtesy. In return, we expect the same respect and courtesy from you. If our staff feels that you are consistently engaging in abusive content toward them, or addressing them in a demeaning or rude manner, your account(s) may be terminated and you may be asked to take your business elsewhere. Abusive conduct includes, but is not limited to, the following behaviors:
  • Repeatedly addressing members of our staff in a demeaning or rude manner. Using profanity in any oral or written communications with our staff, by any medium of communication, including but not limited to e-mail, instant messages, chat, text messaging, fax, postal mail, telephone, voice over Internet Protocol, or in-person communication. Yelling or shouting at our staff. Deliberately using all capital (uppercase) letters in any written communication to our staff; Insulting our staff because of their personal characteristics, or on the basis of their race, ethnicity, national origin, sex, sexual orientation, religion, or housing or economic status; or providing false information to our staff for the purpose of harassing them or wasting their time.

Payment Issues

• User agrees to pay us all charges relating to the use of User's account(s) according to rates and prices stated on said sales order at the time of commencement.
• User is responsible for charges at the time the service is used and we may apply the amount due to User's credit card at any time.
• We reserve the right to suspend access to service for User's account(s) upon an indication of credit problems including delinquent payments or rejection of any credit card charges.
• Credit Card payment: If Customer chooses to pay for services by credit card, Customer grants us the right to charge payments to that card on each due date. Customer further agrees not to challenge nor dispute any charge representing hosting payments.

Refund Policy

• Unless otherwise stated in writing, there is a no refund policy for all of our services and products.
• If you breach this Agreement you service may be immediately terminated without notice and with no refund.

Account Cancellations

• Customers may voluntarily cancel their account at any time, for any reason or for no reason, by opening a ticket to our Billing Department with required details. We require a five (5) day cancellation notice prior to the anniversary billing date for discontinuance or downgrades of month to month services. Failure to supply the requisite five (5) days will result in a full billable monthly cycle prior to cancellation. All due amounts must be settled in full before we cancel the customer account. Customer understands and agrees that we do not provide pro-rated or any other kinds of refunds on cancellations. All fees Customer has paid shall be nonrefundable, unless stated otherwise in writing.
  
  All cancellation requests must be made directly to our Billing Department by opening a ticket. Cancellations requests are not accepted by email, postal mail or by phone. If a customer canceled a recurring order by contacting any 3rd parties, we will consider it as an account cancellation request.
• We reserve the right to terminate any account, for any reason, with or without any prior notice. We do not discuss the reasons for termination of service.

Agreement

• We may modify these terms and conditions upon notice published online via our web site. User's use of our services after such notice shall constitute user's acceptance of the modifications to this Agreement.
• This agreement, User account, contract, and billing will automatically renew unless cancelled in writing prior to the renewal date.
• Any and all disputes or claims arising from this Agreement will be decided in the California Superior Court for Sacramento County. You agree to the personal jurisdiction of the California Superior Courts for the resolution of all disputes.
• This agreement is effective September 1, 2016.
• Modifications on July 1, 2016: no additional .tk, .gq, any freenom registered, or free domains allowed to be hosted.
• Modifications on September 1, 2016: Imposition of fee if you want to change the domain used for your account setup.
• Modifications on October 13, 2016: Ban on all email sending software, including but not limited to mailwizz. You can send emails via your personal email address, but cannot install software used for bulk email marketing.
